Terms of Service

General

The CatWatch mobile application, the catwatch.app website, and related services (together, the "Service") are operated by CatWatch ("CatWatch", "us" or "we"). Access to and use of the Service is subject to these Terms of Service ("Terms"). By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms, including any future modifications.

CatWatch may amend, update, or change these Terms. Where we do, we will update the date at the top of this page and, for significant changes, notify you within the Service. Revised Terms take effect the first time you access or use the Service after the changes are posted. If you do not agree to these Terms, you are not authorised to use, access, or participate in the Service.

How we handle your personal information is described in our Privacy Policy, which forms part of these Terms.

1. Description of the Service

The Service allows users to document cats they encounter, contribute sightings to a shared map, log feedings, maintain a personal list of the cats they have recorded, and interact with other users. CatWatch may, at its sole discretion and at any time, update, change, suspend, make improvements to, or discontinue any aspect of the Service, temporarily or permanently.

2. Your account

In connection with registering for and using the Service, you agree that:

You may delete your account at any time within the Service (Settings → Edit profile → Delete account). Deletion is subject to a cancellation period, as described in the Privacy Policy.

3. No warranty as to content and results

Cat identification, breed detection, colour analysis, and feeding verification are performed by automated models and are estimates, not statements of fact. Health indicators are entered by users and are not a diagnosis.

Cat records, sightings, locations, and feeding entries are submitted by users and are visible to other users of the Service. CatWatch does not verify the identity of the user who submitted a record, and does not warrant that any record is accurate, current, or complete.

The Service does not provide veterinary advice. If a cat appears to be sick or injured, contact a veterinarian or a local animal welfare organisation. Nothing in the Service should be relied upon for the medical care of an animal.

4. Your content

You retain ownership of the photographs and text you submit to the Service ("Your Content"). By submitting Your Content, you grant CatWatch a worldwide, non-exclusive, royalty-free licence to store, reproduce, adapt (including to resize, crop, and compress), and display it within the Service and on public links to cat records, for the purposes of operating and promoting the Service. This licence terminates in respect of any item when you delete that item.

You represent and warrant that you hold the necessary rights in Your Content and that it does not infringe the rights of any third party.

Shared records are retained. Street cat records, sightings, and feeding history constitute shared data on which other users rely. Where you delete your account, such records are retained within the Service without any link to your identity. Content associated with your profile, and domestic cat records you created, are deleted.

CatWatch maintains a zero-tolerance policy towards objectionable content and abusive conduct. You must not use the Service to:

Content submitted to the Service is screened automatically for profanity, unsafe imagery, and abusive text. Users may report content and block other users within the Service.

CatWatch may remove content, restrict access to features, or suspend or delete accounts that are in breach of these Terms. Such action is ordinarily taken following human review, and may be taken immediately where there is a risk of serious harm or where content is unlawful.

7. Availability of the Service

The Service is provided on an "as is" and "as available" basis. CatWatch does not warrant that the Service will be uninterrupted, error-free, or free from loss of data. You are advised to retain your own copies of any content that is important to you.

8. Limitation of liability

To the maximum extent permitted by applicable law, CatWatch shall not be liable for any indirect, incidental, or consequential damages, for loss of data or content, or for any matter arising from your reliance on automated recognition results or from your interactions with animals, other users, or third parties. Nothing in these Terms limits any rights you have as a consumer under the law of your country that cannot be limited by agreement.

9. Third-party services

The Service is distributed through the Apple App Store and relies on third-party service providers (hosting, automated recognition, content moderation, and push notification delivery) identified in the Privacy Policy. The terms of those providers apply to their respective parts of the Service. Apple Inc. is not a party to these Terms and has no obligation to furnish any maintenance or support in respect of the Service.

10. Termination

You may cease using the Service and delete your account at any time. CatWatch may terminate or suspend your access where you are in breach of these Terms. On termination the licence granted in section 4 ends, except in respect of shared records that remain as described in that section.
